Elder Law Prep is operated by Elder Law Prep. References to Elder Law Prep, we, us, and our mean that operator and the service providers used to run the site.

By accessing or using the site, you agree to these Terms. If you do not agree, do not use the site.

Elder Law Prep provides educational information, planning organization, and attorney-preparation help.

It does not provide legal, financial, tax, benefits, medical, fiduciary, or other professional advice.

Using the site does not create an attorney-client relationship, lawyer referral relationship, fiduciary relationship, duty of confidentiality, or professional representation of any kind.

Information you enter is not privileged legal communication and should not be treated as confidential legal advice.

The guide does not draft binding legal documents, prepare final legal instruments, file applications, submit court papers, calculate official eligibility, communicate with agencies, represent you, or take action on your behalf.

A downloaded report is an educational preparation document only. It is not a will, trust, power of attorney, Medicaid application, VA claim, court filing, professional opinion, or legal plan.

Elder law, Medicaid, veterans benefits, estate planning, guardianship, care-cost, and tax rules vary by state, agency, timing, facts, and document language. They also change over time.

State Medicaid figures and planning flags in the guide are planning aids, not official eligibility determinations. Some states may use estimates, secondary sources, or source reviews from different dates.

Verify all information with a qualified local elder law attorney, Certified Elder Law Attorney, accredited representative, agency, CPA, financial advisor, physician, or other appropriate professional before making decisions.

The guide uses AI-generated responses. AI output can be incomplete, outdated, inconsistent, or wrong, even when it sounds confident.

You are responsible for the information you enter, the decisions you make, the professionals you choose to consult, and any action you take or delay based on the guide.

Use approximate or limited details when possible. Do not enter information you are not authorized to share or are not comfortable processing through a web-based AI tool.

Do not misuse the site, attempt to bypass rate limits or bot checks, scrape or bulk-copy the service, reverse engineer protected systems, submit malicious code, overload the service, impersonate others, or use the guide for unlawful or harmful activity.

We may limit, block, throttle, suspend, or change access to protect users, the service, providers, and operating costs.

The site may change, pause, limit, or stop operating at any time. Features, models, providers, limits, prompts, state data, PDFs, and content may change without notice.

We do not guarantee uninterrupted availability, complete accuracy, current law, successful document generation, preservation of browser-saved sessions, or suitability for your specific circumstances.

The site may use third-party providers for hosting, AI processing, security, bot prevention, counters, logs, and infrastructure. Those providers may process data as described on the Privacy page and under their own policies.

We are not responsible for third-party services, provider outages, provider policy changes, or content linked from the guide.

You retain ownership of the information you enter. You are responsible for having the right to share it and for keeping your own records outside the site.

You give Elder Law Prep and its service providers permission to process, transmit, format, secure, and display your inputs and generated outputs as needed to operate the guide, respond to your requests, generate reports, prevent abuse, and maintain the service.

Elder Law Prep owns the site, software, prompts, workflows, design, trademarks, educational content, and generated templates, except for user-provided content and third-party materials.

You may use a downloaded report for personal family planning and attorney preparation. You may not resell, scrape, republish, or use the site or reports to build a competing service.

To the fullest extent permitted by law, you are responsible for claims, losses, costs, or damages that arise from your misuse of the site, unlawful activity, unauthorized sharing of another person's information, violation of these Terms, or reliance on the guide as a substitute for professional advice.

This section is not intended to limit nonwaivable consumer rights you may have under applicable law.

To the fullest extent permitted by law, the guide is provided as is and as available, without warranties of any kind, express or implied.

We disclaim warranties of accuracy, completeness, timeliness, non-infringement, merchantability, fitness for a particular purpose, and professional result.

To the fullest extent permitted by law, we are not liable for decisions, delays, errors, omissions, losses, costs, denied benefits, tax consequences, legal consequences, care consequences, data loss, service interruption, or damages arising from use of or inability to use the guide.

If you are not comfortable with these limits, do not use the site.

These Terms are governed by the laws of Colorado, excluding conflict-of-law rules, except where your local consumer law gives you nonwaivable rights.

If a dispute is not handled in arbitration or small claims court, the exclusive venue will be Colorado state and federal courts, except where applicable law requires another venue.

Before starting a formal dispute, you agree to send a written notice describing the issue and give us 30 days to try to resolve it informally.

To the fullest extent permitted by law, any unresolved dispute will be resolved by individual binding arbitration under consumer arbitration rules before the American Arbitration Association or another mutually agreed arbitrator.

Either side may bring an individual claim in small-claims court if the claim qualifies. Either side may also seek temporary or injunctive relief for misuse, security, intellectual-property, or unauthorized-access issues.

You and Elder Law Prep waive any right to a jury trial or to bring or participate in a class, collective, consolidated, private-attorney-general, or representative action, except where that waiver is not enforceable under applicable law.

We may update these Terms as the site, operator, providers, data sources, legal requirements, or launch posture changes.

The Last updated date shows when the Terms were most recently revised. Continued use after an update means you accept the revised Terms.
